The revenge porn crime charged against Leonardo Apache La Russa has been declared extinct. This was established by the judge for the preliminary hearing in Milan, Maria Beatrice Parati, deeming the compensation offer of 25 thousand euros made by the young man to the girl involved to be appropriate. A decision that closes the criminal proceedings against him, but does not put an end to the legal matter.
The judge’s decision and the extinction of the crime
According to what was established by the preliminary hearing judge, the compensation offer presented by Leonardo Apache La Russa, son of the president of the Senate Ignazio La Russa, was judged adequate for the purposes of extinguishing the crime. A letter addressed to the girl also weighed in favor of the young man, in which he expressed his regret for what happened.
The Prosecutor’s Office, however, opposed the extinction of the crime, deeming the proposed sum inappropriate and supporting the need for a recovery path for the accused. The request was not accepted by the judge.
The condemnation of the friend who had released the video
The position of Tommaso Gilardoni, the DJ who had received the video from La Russa and had subsequently forwarded it to two other people, was different. He received a one-year prison sentence, with a suspended sentence, for the crime of revenge porn.
The complaint for sexual violence and its dismissal
The young woman had also reported Leonardo Apache La Russa for sexual assault, reporting that she woke up without remembering what happened after spending the night in her home, which is located in the house of the president of the Senate. For this charge, the judge accepted the dismissal request made by prosecutor Rosaria Stagnaro and deputy prosecutor Letizia Mannella.
The position of the girl and her lawyers
The girl has already made it known that she will not accept compensation. “I will certainly challenge the provision on fairness,” he declared, announcing the appeal against the decision of the Milan preliminary hearing judge.
His lawyer, Stefano Benvenuto, strongly contested the judgment expressed by the court. According to the defense, the sum of 25 thousand euros would not be adequate to cover the moral, existential and relational damages resulting from the crime, recalling the criteria used in other proceedings for similar crimes, in which compensation can exceed 50 thousand euros.
