Garlasco, because the Poggi continue to consider Sempio innocent and Stasi guilty

The Poggi family rejects the new reconstruction of the crime. Sempio called on May 6th. The defense: will he respond or not, it’s strategy

Once again, the Poggi family doesn’t believe it. And he states it bluntly. After the Pavia Prosecutor’s Office changed the charge against Andrea Sempio, now indicated as the sole person responsible for the Garlasco crime, the family’s lawyers, Gian Luigi Tizzoni and Francesco Compagna, entrusted the Corriere della Sera a clear reply. The new reconstruction would be, in their opinion, “an unreal hypothesis, which seems to have been constructed around the table without taking into account the data already known”.

A position which, in this case, appears a little bizarre, despite the Poggi family has always viewed this new investigation with skepticismsince its inception.

The Garlasco knot

Lawyers Tizzoni and Compagna also raise a procedural issue. They had asked to extend the evidentiary hearing precisely to avoid, they explain, “the proliferation of unfounded reconstructions on aspects already widely clarified by experts and consultants”. However, the Pavia Prosecutor’s Office chose differently, without providing, at least publicly, the reasons for that decision. “We will read the documents”, concluded the lawyers, “to understand what the reasons for these choices were”.

In the background there remains a contradiction that is difficult to ignore: Alberto Stasi is still serving a final 16-year sentence for the same crime. And the new investigation into Sempio has so far not affected that sentence.

Sempio’s defense: «He will go, it is a legal obligation»

The lawyer Liborio Cataliotti, lawyer of the 38-year-old under investigation, is moving on the opposite front. Interviewed at Tg4 Diary of the Day by Sabrina Scampini, clarified that his client will present himself at the summons set by the Pavia Prosecutor’s Office for May 6th. “It is a certainty that Andrea Sempio will go because it is a legal obligation,” declared Cataliotti, adding that together with his colleague lawyer Taccia he will “literally” impose the procedural choice on the client.

To respond or not to respond: that is the question. Both options, the lawyer specified, are legitimate. It will be a decision of strategy, not of opportunity. Cataliotti also underlined a tactical element of the Prosecutor’s move: having summoned Sempio before the investigation was closed made all the documents in the file visible to the defence. A choice, he implied, that did not go unnoticed.

The Garlasco case therefore returns to the center of a tense confrontation between the prosecution and the defense. The Pavia Prosecutor’s Office has effectively rewritten the dynamics of a murder on which a final sentence already existsand it did so at a time when the positions of the subjects involved, family members, accused and lawyers, remain distant and difficult to reconcile. May 6th will be a first test.
