A series of errors, clues and neglected tracks led to the condemnation of Stasi. But the elements against him are weak.
Processes, appeals, sentences, convictions, acquittals and then again convictions. And investigations. Open, closed and reopened. In almost 18 years nobody managed to describe the circumstances in which he was killed in a complete and logical way Chiara Pogginor to match the judicial sentence (definitive) for Alberto Stasi with the historical truth and not even to write the end word on the noir novel of Garlasco. The rough elements still seem to be too much.
The time of death
The death timetable is initially set between 9:12 and 9:35. Stasi does not have an alibi for those 23 minutes. Nobody saw stasis enter or leave the Poggi house. There is no video that takes him back. There is no witness. And that time interval, with access to the PC files, then revealed even wider. The hourly scissor changed during the processes. He enlarged. And the certainty of the time of death has evaporated. Despite this, for the judges of the Stasi Cassation “he provided an alibi who does not eliminate him from the crime scene”.
Clean shoes
For the accusation it is the Test Regina: Stasi could not fail to have dirty his shoes in the blood of the victim, who was everywhere on the floor. Since the era of death is not clear, at the same time it is not clear whether the blood was dry or fresh. A detail that makes the difference. Furthermore, Stasi shoes were seized the following day. After 19 hours. Hours in which Stasi walked around the house, trampled on Ghiaia, participated in an inspection with the carabinieri. He even passed on the wet grass of the garden (particular verbalized by his parents).
The crime scene
As many as 25 people among investigators, legal doctors and necrophors cross the threshold of the house. They enter without shoes. Without protections or caution. There are 17. Complete imprints. Six of these bear the name and degree of three officers of the carabinieri. All without gloves. Manual errors.
Bathroom
An imprint of stasis is found on a dispenser in the bathroom. Together with Chiara’s DNA. The accusation considers her suspect. But this element also appears very weak: Stasi was the boyfriend. He had free access. He used that bathroom. The imprint was to be neutral. It is not known when it was left. It is not known in what circumstance. But for the judges of the Court of Cassation, the imprint “was positioned in a different way compared to the common methods of using a soap dispenser (i.e. pressing the button with the palm of the hand or with a finger), but perfectly compatible, instead, with the gesture of those who grab the object, for purposes other than that of its use”. The absence of blood traces on the lever of the mixer, on the dispenser, or in the siphon of the sink, in the face of the need for the murderer to wash his hands that was brought, is thus overcome by the judges of the Cassation: “It cannot find any other justification if not the one that the washing maneuvers had evidently been in place with considerable accuracy”. In short, Stasi would have been so noticed that he succeeds, washing his bloody hands, not to end the blood material even in the unloading siphon.
The black bike for women
A witness claims to have seen a black woman bike in front of the Poggi house. Stasi confirms that he had one. But that bike was in his father’s shop. And nobody saw Alberto use it that day.
Then it turns out that the Stasi family has different family. The carabinieri, however, do not kidnap them. And the defense unnecessarily complains: “The only relevant data has been neglected, namely that none of the stasis family bicycles can identify with the bicycle spotted outside the Poggi house on the morning of August 13, 2007”. The censorship of the judges is this: “Stasi silent about the possession” of a black women’s bicycle “”. And his position aggravated.
DNA on the pedals
Another piece: Chiara’s DNA on Alberto’s bike pedals. At first analyzes it is blood. Then the Carabinieri of the Ris rethink us: it is probably a false positive. Only DNA. It was enough that Chiara had touched the bike. Or there was one day, as it probably happened.
The light of the cellar
Stasi says he was off. The carabinieri find it on. The judges consider him a suspicious detail. In judicial documents, however, the existence or absence of a sensor is never indicated. Nobody ever verified it.
The ghost hair
Chiara has a short hair in her left hand. It could be of the aggressor. But it is never analyzed. The civil parties ask for it. Nothing. “Not necessary”, according to judges and investigators. When finally a expert can put his hands on it will be too late: the find is now compromised, degraded beyond any possibility of analysis. Time, once again, canceled what science could have revealed.
Forgotten nails
No in -depth analysis under the victim’s nails. The defense argues that the most appropriate procedure “would have been to collect all the biological material detained by the entire surface”. But the judges liquidated the request considering it “exorbitant”. And above all to “avoid repetitions”. Which after 18 years have been considered necessary. And they are, in fact, the basis of the reopening of the investigations.
The scratches
Two brigadieri see scratches on the left forearm of Stasi. They are not photographed. One of the carabinieri thinks that it was the task of the finders. No coroner examines them. The detail also emerges in 2014.
The disappeared photos
The general prosecutor is looking for 41 photos of stasis with friends. They served to understand what shoes he wore. But they disappeared. They were in the barracks, in Vigevano. The prosecutor general during the appeal notices the absence. And the court merely takes note of it.
Incomplete autopsy
Chiara’s corpse is not weighed. Anatomopathologists do not have the scale available. But the weight could have helped to establish the time of death with greater precision. Another lost opportunity. Irrimediably.
The container in the kitchen
An empty fruit container is found on the kitchen table. Nobody analyzes him. In the processes it is never mentioned. But it is among the finds. And it was completely ignored.
No motive
There is no proof of a quarrel, nor the discovery of a betrayal. The presence in the PC of stasis of child pornographic images and research on the theme carried out on the web by Chiara in the sentences do not turn into the reason that would have pushed Stasi to kill the girlfriend, with which, however, the night before he had eaten a pizza. For the judges of the Court of Cassation, however, “the failure to identify a specific motive, that is, the precise reason unleashed the murderous impetus of Stasi” is not a problem. “It does not affect in any way on the overall circumstantial framework against it, nor does it appear necessary to identify it in the case of impetus murder”.
The trials denied
The defense has repeatedly asked for new appraisals. On DNA. On the files. On the car mats. On IT devices. All denied. “Not necessary”, according to the judges. But in a process built on clues and presumptions, any doubts would have deserved to be clarified.
Slopes ignored
To close the case, this principle is used: Chiara killed no one else to kill. Here is the passage of the ruling that stamped Stasi as a killer: “The alternative reconstructions (…) have been considered absolutely imaginative and completely without feedback, if not denied by the acquired results”. And finally: «Chiara Poggi’s life has been dismayed and those who had had to do over time have been felt in the investigations conducted; At the outcome, it emerged that the young woman did not have many friendships and frequentations, less than ever in those days when relatives, friends and acquaintances were on vacation ».
Eighteen years later, however, we return to investigate the frequentations. Because not everyone was on vacation.
