For the Poggi family’s lawyer, the latest investigations into Stasi’s PC are “not only appropriate, but necessary” given that Sempio is “investigated in conjunction” with the former Bocconi student
The back and forth between the lawyers of the Poggi family and those of Alberto Stasi continues after the former revealed the results of the investigations which, in their opinion, would reveal the motive. In fact, according to the IT investigations requested by Chiara’s parents, the girl discovered the pornographic files on Stasi’s computer the evening before she was killed.
«A convict who cannot be tried again»
After yesterday defining the data as “unconfirmed” and “irrelevant”, Stasi’s lawyer, Giada Bocellari, stated that it is a “continuous attempt” by those who follow “the offended people, to seek, through public announcements, alleged new evidence against a convicted person who under no circumstances can be tried again”. And it would be “a significant stance”. Stasi’s other lawyer, Antonio De Rensis, was also a guest on the show The state of thingsstated: «In the Code that I know there is “ne bis in idem”, but in recent weeks I have seen Codes appear that are different from those I know. I have seen in recent days that the consultancies of some parties generate certainties, those of the Prosecutor’s Office exchange minutiae with the wall, dreaming of seeing new footprints.” Bocellari then explained that “if all this were really decisive for the purposes of truth” the materials collected by the Poggi family consultants “should be offered without delay” to the prosecutors of Pavia so that they can be “evaluated in the ongoing investigation against Sempio”. Also because, he continued, “new elements, such as judicial actions” should be “filed in the competent offices, as the Stasi defense has already done, is doing and will do in silence”.
The reply: «Duty verification»
The response from the Poggis’ lawyer, Gian Luigi Tizzoni, was not long in coming. “Any investigation is not only appropriate, but necessary” given that Sempio is “under investigation in conjunction” with the Stasi, Tizzoni said. Who continued: “I don’t understand the agitation” of Stasi’s lawyers and “in what capacity” are they speaking given that “the evidentiary incident is over and with this also their unprecedented role as lawyers for the third party involved”. However, he underlined that if Stasi’s lawyers “were to promote a review proceeding, they know well that the plaintiffs in the Poggi family will be called upon to participate.” The Poggi family’s lawyers will wait for the conclusion of the preliminary investigations into Andrea Sempio or a hypothetical request for review of the trial by Stasi’s lawyers, before deciding whether to file the results of the new report.
