Garlasco, what are the next steps? Here’s how and when it could end

Stasi convicted, Sempio investigated. The latest consultancy on DNA and computers is awaited. At what point are the investigations into the Garlasco case

There are many elements regarding the Garlasco crime, too many. They intertwine and confuse the waters. So let’s try to clarify things a bit: at what point are the investigations? What are the next steps? And when will there be a decisive response, beyond the overnight changes to which we are now accustomed?

Almost eighteen years after the murder of Chiara Poggi, we have entered a very delicate phase. Alberto Stasi is condemned definitively as sole responsible. Andrea Sempio is under investigation by the Pavia Prosecutor’s Office for the same crime, but in complicity. Two parallel tracks that could intersect, or not. Everything will depend on the next few weeks.

What could happen to Sempio

The proceedings against Sempio can end in two ways. The Prosecutor’s Office can request indictment or dismissal. In the first case, a preliminary hearing would be held before the Judge for Preliminary Hearings (Gup), who will assess whether there are sufficient elements for a trial. If so, Sempio he would end up before the Court of Assizes of Pavia accused of voluntary murder in collaboration with Stasi or others.

However, if the Prosecutor’s Office requests the dismissal, a Judge for preliminary investigations (GIP) will have to evaluate its validity. The Poggi family could oppose itcontinuing the process. But without solid evidence, the case would end here.

What could happen to Stasi

Stasi was definitively condemned. Judgment that has become final (i.e. it can no longer be questioned or modified through ordinary means of appeal such as appeal or appeal to the Court of Cassation). The only tool to overturn it is the review of the processa complex procedure with an uncertain outcome. The defense can request it from the Court of Appeal of Brescia for two reasons: either because a definitive sentence emerges against Sempio which recognizes him as the sole perpetrator of the crime (and therefore incompatible with the one against Stasi), or because new decisive evidence emerges.

The review first passes through a preliminary eligibility phase. If passed (which Olindo Romano and Rosa Bazzi failed to do in the Erba case), the trial reopens. Reasonable doubt is enough to obtain acquittal: it is not necessary to demonstrate innocence, but to undermine the certainty of conviction. If accepted, Stasi would be released from prison and would be entitled to compensation for judicial error.

Decisive advice for a possible trial

The latest technical analyses, considered potentially decisive, will arrive in the next few weeks. The Scientific Investigations Department (Ris) of Cagliari is completing the DNA checks. Then there’s the Bloodstain Pattern Analysis (Bpa), the analysis of blood traces at the crime scene. According to some previews, this consultancy could “rewrite” the times and methods of the attack. However, it will only be made public once the investigations are closed.

But there is a third possibilitythe most intricate: that Sempio is condemned as a participant in the crime together with Stasi. In that case, the review would become more difficult, because there would be no incompatibility between the two sentences.

In any case, everything will depend on the next consultations, which will clarify whether Garlasco’s crime will finally have a fixed point. Or other question marks.
