The appeal and the hearing in the Court of Cassation

The Milan Public Prosecutor’s Office had challenged the semi -freedom measure, claiming that the ordinance presented vices of legitimacy, especially following the interview issued by Stasi to “Le Iene” on 30 March last, during a prize permit granted for reasons of family reunification. According to the Prosecutor, the prize permits must be granted exclusively for family, cultural or work reasons, and the television interview would not fall within any of these categories.

The hearing in the Court of Cassation took place without the presence of the parties, in a phase defined as “paper”, during which the judges examined the appeal, the observations of the attorney general and the defensive memories. The decision to reject the appeal confirmation of the semi -freedom granted to Stasi, but in the event of acceptance the story would have postponed to the Milan surveillance court for a new judgment.

Prize permits and the case of the interview with Le Iene

Among the central issues raised by the General Public Prosecutor there is the lack of specific authorization for the participation of Stasi in the television interview during a prize permit, considered not compliant with the purposes provided for by the legislation. This aspect fueled doubts about the correctness of the surveillance measure, but the Cassation considered that it was not enough to revoke semi -freedom.
