Garlasco, we’re playing cards face down: Sempio’s defense is looking for a decisive test

Cataliotti on La7: Sempio’s defense focuses on the presumption of innocence. But he admits that he is looking for evidence in his defense

In Garlasco, the cards have not yet been revealed. Andrea Sempio’s defense revealed its strategy, which would be based on presumption of innocence. The lawyer confirmed it Liborio Cataliotti during the program «Ignoto X», on La7, returning to the developments of the reopened investigation into the Garlasco crime. Sempio is under investigation for the murder of Chiara Poggi.

The lawyer, who assists the suspect together with the lawyer Angela Tacciaclarified the approach chosen by the defense team. It is not up to them, he explained, to prove the innocence of their client. Instead, it is up to the prosecution to prove his guilt.

“I remind everyone that there is a principle in force which is that of the presumption of innocence, therefore I, the defender, I and the lawyer Taccia will not be called upon to seek anything exculpatory,” said Cataliotti. And he added: «It should be enough to dismantle or demonstrate the inconsistency or perhaps even just theinsufficiency of the mass of evidence against Andrea Sempio».

The search for exculpatory evidence

Soon after, however, came an opening that caught the viewers’ attention. «But I confess that we are looking for decisive exculpatory evidence, as we understood from our consultancy on shoes. But I won’t go any further because I don’t want to reveal all the cards», said the lawyer, without adding details.

For weeks, in fact, the legal team has been working with various technical consultants to verify the validity of the conclusions reached by the Pavia prosecutor’s office. The in-depth analyzes concern in particular the medico-legal, genetic and dactyloscopic aspects collected during the investigation.

The knot of shoe prints

One of the most discussed points remains that of the shoe prints found at the crime scene. According to the defense, the dimensions of Andrea Sempio’s foot would not be compatible with the traces examined by investigators. It is on this element that, according to Cataliotti’s words, part of the consultants’ work would focus.

The psychiatric report and its role on Garlasco

At the same time, the Pavia prosecutor’s office entrusted the psychiatric assessment of Sempio to the psychiatrist Roberto Catanesi. The objective is to ascertain the possible presence of pathologies that may have influenced the suspect’s capacity of understanding and will at the time of the events.

On this point, Cataliotti was keen to specify a limit: the expertise, he said, cannot “be imposed”. The defense team will decide if and when Sempio will undergo the examination, waiting for the investigation to proceed with the new technical investigations announced by the defence.
