Chiara Poggi’s family will not be a civil party in a possible trial against Andrea Sempio after the new investigation by the Pavia Prosecutor’s Office into the murder.
“We do not make financial claims against innocent people”, they say through their lawyers, specifying however that they are ready to appear in the event of a review of the Stasi trial. Why this “defense” of Sempius? TO Garlasco the trial has yet to begin, but for the two families involved the verdict is already ready: Alberto Stasi guilty, Andrea Sempio innocent. The Poggis are ready to appear in a possible review of the first’s conviction, but not against the second: “We have no economic claims to make against innocent people”, explains the lawyer Francesco Compagna. Also representing Chiara’s family is her colleague Gianluigi Tizzoniwho vindicated the choice of the Poggi family: «I believe in the truth ascertained judicially with sentences reached after about ten years of trial which have already supported two steps in Cassation».
The unexpected axis between families and the crux of the final sentences
A total closure with respect to any alternative hypothesis to the Stasi’s guilt. A certainty that coincides with that of the Sempio house and that resists the new protests of the Pavia Prosecutor’s Office, the doubts about the analyzes of the Carabinieri of the Res and to the new interceptions just filed. Including those in which Andrea’s mother takes it out on Chiara and her family. Positions converge on the son’s innocence.
On respect for the victim, no. «My son had absolutely nothing to do with Chiara Poggi’s murder», he reiterated Daniela Ferrarithe mother of the former clerk of Voghera who, according to the Pavia prosecutors, massacred poor Chiara that morning 19 years ago after refusing a sexual approach. Two families with crossed destinies, perched on positions that end up coinciding.
The yellow of the pedals and the file reopened by the investigators
The Poggis are not dismayed even by the alleged mess on the part of the Ris of Parma on the DNA of Chiara on the pedals of Alberto Stasi’s bicycle, one of the clues that had the greatest investigative and procedural weight against Chiara’s boyfriend. For lawyer Tizzoni, faced with “two markedly positive extractions with 16 haplotypes”, the negative outcome of the counter-analysis the following day (it was 20 September 2007) would have come from a machine that would not have “given any results”. But as we have also seen in the Sempio home, certainties about Andrea’s innocence do not seem to be lacking. Yet, the new wiretaps just filed by the investigators reveal a certain resignation on the part of the person concerned, at least with respect to the fact of ending up “sooner or later” under investigation again. As happened in 2017, when the suspicions against him ended with a dismissal order which in turn came under the scrutiny of the investigators who relieved the former deputy prosecutor of Pavia of all responsibility, Mario Vendittibut the corruption case which sees Andrea’s father among the suspects was left open and transferred back to Pavia, Giuseppe Sempio and it seems to involve, we will see to what extent in the coming months, also the work of the judicial police.
The unpublished wiretaps and the doubts raised in the phone calls
But let’s go back to the closeness between the vision of Chiara Poggi’s family and that of Andrea Sempio. Unique visions which however must inexorably deal with the current scenario. That of a reopened case, of a terrible feminicide that could be rewritten in detail by the Pavia Prosecutor’s Office. The harsh outburst of Andrea’s mother is an all too clear demonstration of this when in an interception she addresses the victim and her family thus: “Damn Chiara, the Poggis and the pig (blasphemy) who doesn’t let them die… damn you.” And also when, in a conversation about a year ago, Daniela Ferrari talks about the general Luciano Garofano. A dialogue in which, the carabinieri summarize, Andrea’s mother talks about the alleged fears of Garofano and the lawyer Tizzoni linked to the possibility that a different scenario could emerge compared to the guilt of Alberto Stasi.
Fears that seem to leave Ferrari itself perplexed, with the woman even wondering the reason for those doubts on the part of those who were sure they had done their job well at the time of the events. A job that General Garofano continues to defend with all his might, as does the work of his collaborators. «We communicated that Chiara’s DNA was on those pedals, that that trace was highly likely blood. We never said it was blood”, specified the former head of the Parma Ris who over the years became the consultant of Andrea Sempio’s family.
The genetic evidence under the nails towards the indictment
But there are many other aspects to clarify and tracing everything back to the mystery of the DNA on the pedals would be reductive and above all misleading. There is another genetic trace that could write a different ending for the Garlasco case and it is the DNA found under the nails of Chiara who, before being overwhelmed by the blind fury of her killer, defended herself for a long time. For geneticists Carlo Previderè And Pierangela Grignani the concordance of the alleles of the two samples extracted from Chiara’s nails with those of Andrea Sempio has “only one explanation”, namely that the suspect and his entire paternal line “cannot be excluded as a contributing subject” of that profile. And this is undoubtedly one of the most important papers that the Pavia Prosecutor’s Office will put on the request table indictment.
