Reduced fines and stop double compliance. The so-called Save Home goes into maneuver. With a proposal signed by the Fratelli d’Italia senators Matteo Gelmetti and Domenico Matera we are moving towards a restyling of the decree created a year ago to manage the small building defects present in millions of Italian properties. An intervention that aims to simplify procedures for owners, technicians and municipal offices, without entering the field of building amnesties, where the Government is moving on other tracks. The next parliamentary steps will tell if the “new Save Home” will really enter the budget law.

Save Home: we are moving towards a definitive farewell to double conformity

Part of the proposal concerns the reform of the conformity assessment mechanism. To remedy the partial discrepancies and essential variations of many buildings, the principle of double conformity was and is still valid (except for changes in the Budget Law). To obtain the permit today it is necessary to demonstrate the urban planning compliance of the work to be remedied at the time of submitting the application and the building compliance at the time of carrying out the intervention. A mechanism that technicians and operators define as an obstacle that blocks regularization even when the work is compatible with today’s rules. The amendment proposed in the Maneuver proposes a radical change: aligning the two checks and considering a single parameter, the one in force at the time of submission of the amnesty application. To obtain the amnesty it will be sufficient to demonstrate urban planning and building compliance at the time of submitting the application. According to estimates by operators in the sector, a very large number of files stuck in Municipalities’ drawers would be unblocked.

Then there is the economic part of the proposal of Fratelli d’Italia in Maneuver: a vertical cut of the sanctions necessary to regularize the most serious discrepancies.
The maximum fine, currently set at 10,328 euros for interventions carried out in the total absence of Scia or in non-compliance with it, would drop to 2,068 euros, with the possibility of further reductions in specific situations. The conformity assessment would have more accessible costs for families and property owners. From here, according to the majority, there would be a push towards the regularization of properties. And furthermore, to lighten the mechanism, the amendment proposes to completely exclude the Revenue Agency from the process of determining sanctions.
