The investigation against Leonardo Apache had left after the complaint of a 22 year old, who had met the son of the President of the Senate in the disco on May 19, 2023. Now the surprise move
After a long and accurate investigative procedure, the Milan prosecutor asked for the archiving of the accusation of sexual violence against Leonardo Apache la Russason of the President of the Senate Ignazio La Russa and for his friend Tommaso Gilardoni. The prosecutors believe that the young man was unable to fully understand the girl’s ability to understand and want. However, the question remains open: the investigators now investigate the spread of intimate videos that could configure the crime of Revenge Porn.
The context of the facts
The story began with the complaint of a 22 -year -old who met Leonardo in the disco on the night between 18 and 19 May 2023, after an evening at the Apeophis Club in the center of Milan 2023. The young woman, immersed in a mix of alcohol and drugs, found itself in a state of deep confusion. The complaint tells a complex story of experiences experienced between perception and reality. The investigators collected testimonies and appraisals which, however, raised doubts about the full configurability of the crime of sexual violence, given the particular mental condition of the girl at the time of the event. The two ended up under investigation following the young man’s complaint, who had said he woke up naked at home La Russa, without memory of the incident and convinced that he had been drugged. The medical report spoke of bruising on the neck and a scratch with one leg, but after almost two years of investigations the prosecutor Rosaria Stagnaro, with the addition of Letizia Mannella and the prosecutor Marcello Viola, considered there were no elements to support the accusation in
judgment.
The rehearsals and videos disputed
Although the accusation of sexual violence has been archived due to lack of sufficient elements, numerous videos emerged that date back to the night of the facts. The material, taken from the devices of the suspects, includes filming of intimate moments and relationships in different environments. Among these there is a video shot by Leonardo himself and other recordings that document episodes in different contexts. Filming raises strong suspicions, as they do not support a pure consensual dynamic. The unauthorized diffusion of these images could configure the crime of Revenge Porn. The investigators have started further investigations to verify whether, in fact, the material was widespread without the consent of the person portrayed, thus violating the privacy and dignity of the denunciation. To date, the two boys are investigated for the alleged non -consensual diffusion, within their circle of friends, of video with sexual content of the girl made that same night.
The versions in comparison
Leonardo La Russa with firmness that the relationship took place consensually, despite the alteration of the mental state of both due to the assumption of substances. The lawyers of the defendants highlight, for example, how the expertise performed on the young man’s hair has not detected significant traces of GHB, also known as “rape drug”. On the other hand, the lawyer Stefano Benvenuto, who represents the young denunciation, claims that the evidence collected – together with the testimonies of the night in question – arise serious doubts about the girl’s ability to give informed consent, thus contributing to the complex picture of the situation.
The president of the Senate, Ignazio La Russa, commented on the story by saying: “I hope this choice can end a period of great suffering, not only for my son, but also for the young woman involved”. Although the accusation of sexual violence has been archived, Leonardo La Russa and the accomplice Tommaso Gilardoni risk a procedure for Revenge Porn, a crime that the authorities intend to deepen with further investigations.
